• Yu Spa Terms & Conditions

    The following terms and conditions are the standard Yu Spa Terms and Conditions and shall be incorporated into any Yu Spa Membership Agreement.

    Constitution

    • Yu Spa is owned and managed by Apex Hotels Ltd, a company incorporated in Scotland, (Company Number SCO73489) and having its registered office at 32 Hailes Avenue, Edinburgh, EH13 0LZ ('Apex').
    • Yu Spa aims to offer a health and well being facility to its members. Apex reserves the right to vary, add or eliminate any of the particular services and facilities provided by them from time to time. Where reasonably possible, notices shall be displayed in the club notifying any changes to the services or facilities at least 2 weeks in advance.
    • Apex reserves the right to set aside facilities with notice for any conferences, exhibitions or other social events or activities.
    • Apex reserves the right to close or withdraw any facility with or without notice, for any period in connection with maintenance deemed necessary by Management.
     

    Membership**

    Use of the facilities is available upon acceptance of your membership and after a health and lifestyle consultation. Acceptance of membership is at Apex's absolute discretion and shall constitute a legally binding contract between Apex and the member upon the terms and conditions contained herein.

    • The initial membership period shall be for a period of 3 months(the 'Initial Period'). A member shall not be entitled to terminate or suspend his/her membership during the Initial Period.
    • This Agreement is personal to the member and cannot be assigned, transferred or otherwise disposed of by the member. Apex may assign the benefit of this Agreement to a third party at any time.
    • Members are issued with a membership card which is required for entry to the club. A fee will be charged for replacement cards.
    • Linked Members must live at the same address as the Head Member to benefit from any discount.
    • Where Linked membership fees are paid by Direct Debit, they must be paid from the Head Member's bank account.
    • Where this Agreement is signed by a Head Member and a Linked Member their obligations shall be joint and several. Any notice by one such person shall be deemed to have been given by both.
    • If a Head Member ceases to be a member and the Linked Member wishes to continue to use the facilities, the Linked Member must become an individual member and pay the individual rate.
    • Applicants for membership must be at least 18 years old. Apex reserves the right to permit entry to younger persons from time to time for sports development purposes at Apex's sole discretion.
    • In applying for membership the member warrants and represents that he/she is in good physical condition and that he/she is capable of all forms of exercise and that such exercise would not be detrimental to his/her health.
    • No family memberships available
    • Under 16s are not permitted to use the spa.
    • Membership fees are payable by direct debit and must be from the same bank account. Minimum term is 3 months.
    • All offers are subject to availability and cannot be used in conjunction with any other offers or discounts.
     

    Subscriptions

    • The member shall pay the Joining Fee and Subscription detailed in the Yu Spa Membership Agreement. The Joining Fee is a one-off, non-refundable charge. Payment shall be due from the acceptance of membership.
    • Monthly Subscription payments shall be made in advance by direct debit from the member's designated bank or building society account. Payments are due on the third day of each month.
    • A Discount is available to members choosing to pay their Annual Subscription in advance in one lump sum payment. Apex reserve the right to vary this offer.
    • Apex reserves the right to review the Subscriptions periodically. Members will be given at least 30 days notice in writing of any changes, which apply to the members as follows:
      1. Monthly Direct Debit payers must pay any increased subscription from the date at which it becomes applicable
      2. Members who pay annually in advance will be subject to any increased subscription after expiry of the year pre-paid.
       
     

    Rules and regulations

    • Apex shall make the Yu Spa Club Rules (the 'Club Rules'). These are provided to members for their safety and enjoyment of their membership. A copy of the Club Rules will be provided to each member at the time of joining Yu Spa and a copy shall be available at Reception. The Club Rules form part of the Yu Spa Membership Agreement and each member agrees to abide by its terms.
    • Apex reserve the right to suspend or terminate membership if a member's conduct is in breach of the Club Rules.
    • Apex reserve the right to vary the Terms and Conditions and the Club Rules from time to time. Any changes to the Terms and Conditions or the Club Rules shall be posted at Reception which will constitute due notice of all changes.
    • Lockers are provided for use on a daily basis. Apex may remove any items left overnight in a locker. These contents can be claimed from the hotel reception. Apex will not be responsible for any unclaimed items after six weeks.
     

    Guests

    • Members must report all guests to reception. No guest will be permitted entry to the club without the members and the guest first signing the Yu Spa Guest Pass and Disclaimer which shall form part of this Agreement. Apex may, at its sole discretion, refuse entry to or eject from the club any guest not properly admitted in accordance with this clause 5.
     

    Liability

    • Apex's liability for death, personal injury or damage to a member's or guest's property is limited to loss or damage incurred as a result of the negligence of Apex, its staff or agents. For the avoidance of doubt, Apex shall not be liable in contract, negligence, breach of duty or otherwise by reason of or in connection with this Agreement or in any other circumstances for any indirect or consequential loss.
     

    Termination and suspension if membership

    • Either party may cancel the membership at any time by giving 30 days written notice to the other party.
    • Apex reserves the right at any time to cancel or suspend the membership of any member in event of the following: (i) the member commits a serious or repeated breach of this Agreement and the breach, if capable of remedy, is not remedied within 7 days of receipt of a default notice, or (ii) where any monies due to Apex by the member remain unpaid 30 days after its due date for payment; or (iii) the member knowingly provides false details when applying for membership and the false declaration would have reasonably affected Apex's decision to grant the membership.
    • If Apex terminates for any of the above reasons, they reserve the right to retain a proportion of the Subscription paid to cover any reasonable costs they have incurred as a result.
    • Membership may be suspended for up to 3 months on medical grounds. A Medical Certificate may be required. Members will be liable to pay an administration charge to suspend their membership.
     

    Loyalty program terms and conditions

    1. Points will be awarded for treatments at Yu Spa and the purchase of Elemis products from Yu Spa.
    2. Points will be awarded for your total bill during your stay at any Apex Hotel.
    3. 500 Referral points will only be awarded after the new member has paid for a minimum of 3 months membership or stayed a minimum of 5 nights at an Apex hotel.
    4. Referral points will only be awarded for NEW members and not re-joining members.
    5. Spa members will not be awarded points for food and beverage only but are entitled to a 15% discount off food and beverage when presenting their Membership Card at any Apex Hotel up to a maximum of 10 people.
    6. Points will not be awarded for Spa membership fees.
    7. Points will not be awarded for the purchase of Gift Vouchers.
    8. Points will not be awarded for Personal Training Programmes.
    9. Group corporate membership where membership to paid for by the company / body is excluded from this scheme.
    10. Leisure card must be presented or membership number given prior to use of any services or purchase of any products for points to be awarded.
    11. Bonus points are only being issued to existing members who have joined prior to the 1 May 2012.
    12. We regret that we are unable to allocate points for services or products purchased prior to registering.
    13. Points are non transferable and cannot be redeemed for the cash equivalent.
    14. Points cannot be redeemed after a membership is terminated.
    15. Points are non transferable and cannot be redeemed for cash equivalent.
    16. Apex Hotels Ltd reserves the right to substitute a reward of equal value or quality should the specified reward become unavailable for reasons beyond our control.
    17. Apex Hotels Ltd reserves the right to remove the Apex Rewards program at any time.
    18. Apex Hotels Ltd does not accept responsibility for availability and redemption of awarded non Apex vouchers.
    19. Apex Hotels Ltd reserves the right to verify the eligibility of entrants. Apex Hotels Ltd decision is final and no correspondence will be entered into.
    20. By registering, clients agree to receive e-mail updates from this rewards program. Should you wish not to receive such updates, please advise by e-mail.
    21. We are not responsible for any unauthorised use of points.
    22. We may suspend or terminate your account if you have breached any of our terms and conditions or if we suspect third party interference with your account.
    23. We may need to revise and amend these terms and conditions from time to time. If we change our terms and conditions, we will give you as much notice as we reasonably can. Earning and/or redeeming points after a change to our terms and conditions means you accept the amended terms and conditions.
    24. A member of this loyalty program can purchase points for cash at the value of 4p per point. Please send your request to rewards@apexhotels.co.uk.
    25. All terms & conditions are in conjunction with our goods supplier (AV Corporation) who's terms & conditions are displayed on this website.
